forwarrantyrepairwhereComtechEFDataCorporationcannotidentifythecauseofthe

reportedfailure.

Exclusive Remedies

Comtech EF Data Corporation’s warr anty , as stated is in lieu of all  other warranties,

expressed, implie d,  or st a tut ory,  including those of  mercha ntability and fitness for a

particularpurp ose .The buyershallpassontoanypurchaser,lessee,orotheruserof 

Comtech EF Data Corporation’s products, the aforementioned war ra nty,  and shall

indemnifyandhold harmlessComtechEFDataCorporationfromanyclaimsorliability

ofsuchpurchaser,lessee,oruserbaseduponallegationsthatthebuyer,itsagents,or

employees have made additional warranties or representations as to product

preferenceoruse.



Theremediesprovidedhereinarethebuyer’ssoleandexclusiveremedies.ComtechEF

Data shall not be liable for any direct, indirect, special, incidental, or consequential

damages,whetherbasedoncontract,tort,oranyotherlegaltheory.


